For the purposes of applicable data protection law (including Turkish Law No. 6698 on the Protection of Personal Data (KVKK) and, where applicable, the EU GDPR), we are the data controller for the information described below.
2. Information we collect
We collect only what we need to respond to you and to run the website:
- Enquiry and RFQ forms: name, company, email address, phone/WhatsApp number, vessel name, IMO number, delivery or service port, required date, IMPA codes or item details, your message, and any file you choose to upload.
- Emails and phone calls you send to us, including the details you include in them.
- Technical data: IP address, browser and device information, pages visited and similar usage data, collected through cookies and similar technologies (see our Cookie Policy).
3. Why we use your information
- To answer your enquiry, prepare quotations and provide requested supply or service support.
- To communicate with you about an existing request or order.
- To keep the website secure and prevent spam and abuse (for example, through Google reCAPTCHA).
- To understand how the website is used and improve it (analytics).
- To meet legal, accounting and regulatory obligations and to establish, exercise or defend legal claims.
Our legal grounds under KVKK are set out in our Turkish KVKK Aydınlatma Metni. Where the GDPR applies, our legal bases are: Article 6(1)(b) where processing is necessary to take steps at your request before entering into a contract or to perform a contract with you; Article 6(1)(c) for legal obligations; Article 6(1)(f) for our legitimate interests in responding to B2B enquiries, managing customer and supplier communications, operating and securing the website, and establishing, exercising or defending legal claims, where those interests are not overridden by your rights; and Article 6(1)(a) consent where required, including for non-essential analytics and optional third-party content.
Where a form field is marked as required, we need that information to process your enquiry. If you do not provide required information, we may be unable to respond or prepare a quotation. Other fields and file uploads are optional unless they are needed for the service you request.
4. Who receives your information
We do not sell personal data. We may share it only as needed: with website hosting and email providers to operate the website and communications; with Google Analytics for website analytics, Google reCAPTCHA for spam and abuse prevention, and Google Maps for the contact-page map; with suppliers or service partners where needed to fulfil your request; and with competent authorities where required by law.
5. International transfers
Some of our providers, including Google, may process personal data outside Türkiye and, where the GDPR applies, outside the European Economic Area.
6. How long we keep it
We keep personal data only for as long as needed for the purposes above, including any legal, accounting or reporting requirements, and then delete, destroy or anonymise it.
7. Your rights
Under KVKK Article 11 and, where applicable, the GDPR, you may ask us to: confirm whether we process your data; provide information about the processing; tell you the purposes and whether they are used appropriately; identify recipients in Türkiye or abroad; correct incomplete or inaccurate data; delete or destroy data; notify third parties of corrections or deletions; object to results produced solely by automated analysis; and claim compensation for damage caused by unlawful processing. Where applicable you may also request data portability, restrict or object to processing, and withdraw consent at any time.
Where the GDPR applies, you may exercise your GDPR rights by contacting info@berthmarine.com or writing to our address above. Requests under KVKK must be submitted using a method permitted by KVKK Article 13 and the applicable Communiqué; the detailed application procedure is set out in our KVKK Aydınlatma Metni. You may also lodge a complaint with the Turkish Personal Data Protection Authority or, where the GDPR applies, the competent supervisory authority.
8. Security
We use reasonable technical and organisational measures to protect personal data. Files you upload through our forms are used only to handle your enquiry. No method of transmission or storage is completely secure, so we cannot guarantee absolute security.
9. Cookies
Information about cookies and similar technologies is in our Cookie Policy.
10. Changes
We may update this policy from time to time. The date at the top shows when it was last changed.
11. Turkish notice
